Understanding Surrogacy Legal Support in Texas
Surrogacy is a growing path for many who are unable to carry a child themselves. Gestational surrogacy is permitted in Texas under Tex. Fam. Code §§ 160.751–160.763, which allows married Intended Parents to pursue gestational surrogacy provided they comply with the statutory requirements, including obtaining court approval of the Gestational Carrier Agreement before the birth. Texas provides strong protections for all parties when the legal process is followed correctly. However, as Texas has strong laws around abortion, a carefully crafted legal agreement is a must.
